The arrival of the Verifactu system has generated much debate among companies and self-employed professionals. Regulatory framework and tax implications
The Verifactu system is part of the amendment to the General Tax Law and the new Regulation governing invoicing systems, approved by Royal Decree 1007/2023. This regulation establishes the obligation for all invoicing programmes to generate records that are inviolable, complete and verifiable by the Tax Agency, with the aim of ensuring the complete traceability of transactions.
Each invoice must include an alphanumeric identification code and a QR code, which will allow the Tax Agency to verify its authenticity and chronological sequence. This reinforces fiscal transparency and helps prevent invoicing fraud.
From a practical point of view, this change means that companies will have to validate the accounting of their current systems, although they are not obliged to automatically send invoices to the Tax Agency. They will be able to choose between two options: Verifactu, with immediate transmission of data to the Tax Agency, or No Verifactu, without this transmission but with the same certification, control, electronic signature and QR code requirements.
