Purpose and scope of application

The following General Terms and Conditions of Contract and Use ("General Conditions") govern the provision of funds, registration for training activities and events, and the payment of invoices issued by GRUP CARLES GESTIÓ I PROJECTES, SL (hereinafter "the holder") through the website www.grupcarles.com (hereinafter "the website"). The term "customer" refers to both consumers and users as defined by the legal concept established by the General Law for the Defense of Consumers and Users, as well as individual or legal persons who are entrepreneurs or professionals. In cases where any of these General Conditions or their regulation refers only to consumers and users, or only to entrepreneurs or professionals, it will be specifically indicated.

Both browsing the website and using it for the payment of invoices issued by the holder, for the provision of funds, or for registration for training activities and events, constitute the acceptance, without any reservations, of all these General Terms and Conditions of Contract and Use by the customer.

By accepting these conditions, as a user, you will be bound by them, which, together with the privacy policy, will govern the contractual relationship between the user and the holder.

If the user does not agree with any part of these General Terms and Conditions, they cannot use the payment services for invoices, provision of funds, or registration for training activities and events offered on the website.

The user undertakes to make lawful use of the website and the services offered, respecting current legislation and refraining from harming the rights and interests of third parties and the holder.

The holder may modify the website and these conditions to make any changes and modifications that it deems convenient and necessary for its proper functionality, without prior notice.

GRUP CARLES GESTIÓ I PROJECTES, SL (the holder) is a duly constituted company with its registered office in Igualada (08700), at Rambla Sant Ferran, number 45, tax identification number CIF B-63344329, and is duly registered in the Commercial Register of Barcelona, Volume 36071, Page 52, Sheet B-276079, Entry 1st.

Minimum Age for Contracting

The services offered on the website of GRUP CARLES GESTIÓ I PROJECTES, SL are only available to legal entities and individuals over 18 years of age.

By accepting these general conditions, the customer declares that they are of legal age (at least 18 years old) and have the legal capacity to use the services offered through the website www.grupcarles.com, and that they understand and comprehend the general conditions in their entirety.

Services

The services offered by the company GRUP CARLES GESTIÓ I PROJECTES, SL through its website include the payment, through virtual platforms, of invoices issued by the company, provision of funds, and registration for training activities and events.

Use of Services

For the payment of invoices, the customer must access the 'Payment Platform' section, located in the 'Online Services' menu on the website, and provide the invoice number for which they want to make the payment.

For the payment of funds, the customer must access the 'Payment Platform' section, located in the 'Online Services' menu on the website, and indicate the concept of the fund provision for which they want to make the payment.

For the payment of registration fees for training activities and events, the customer must access the 'Payment Platform' section, located in the 'Online Services' menu on the website, and indicate the reference of the training or event for which they want to make the payment.

Once the required data is entered, the website will direct the customer to the payment interface, where they will need to enter the amount and choose the type of payment they wish to make from the options provided.

After making the payment, it will be verified that the amount paid corresponds to the amount of the invoice, fund provision, or registration fee for the relevant training activity or event, as the case may be. If it does not correspond, the user will be required to regularize the payment. If the user fails to do so within 5 business days from the date of the request, appropriate actions will be taken.

The user is responsible for the accuracy of the data provided on the website when making the respective payments and, therefore, is liable for any consequences that may arise from providing false or incorrect information.

Form of payment

Customers can make payments for the reference amounts to the company GRUP CARLES GESTIÓ I PROJECTES, SL, through any of the following means:

Payment with credit or debit cards:

Payment with credit or debit card is processed through the banking entity "Banc de Sabadell," which has high-security systems. The banking entity accepts major credit and debit cards, including Visa and Mastercard.

This payment method does not entail any additional cost for the user.

When selecting the "credit card payment" option, the user will be directed to the payment portal screen where they will be asked to enter the total amount to be paid.

On the encrypted screen, the user will need to enter their card details, which will only be known to the banking entity, Banc de Sabadell.

Once the payment is accepted, the company receives it and verifies it. Only the company will have confirmation that the payment has been made.

Payment through the BIZUM system:

To make a payment through the BIZUM system, the user should connect to their bank's platform, specifically the BIZUM section. From there, they will need to enter the phone number associated with the service and the online shopping key for BIZUM (if the user doesn't have this key, they can request it from their bank).

The user will receive an SMS with a confirmation code that they will need to enter in the payment window and then complete the transaction.

The minimum amount for using this service is 0.50 Euros.

The possibility of using this service is subject to the availability of each bank to carry out online purchases through the BIZUM system.

The domain owner may modify the payment methods, duly notifying users.

In order for GRUP CARLES GESTIÓ I PROJECTES, SL to take the necessary actions, the customer must promptly notify them of any unauthorized or fraudulent charges. This notification can be made by postal mail to the address Rambla Sant Ferran, number 45, Igualada (08700), by email to grupcarles@grupcarles.com, or by calling the phone number 93 801 72 20.

Refund

According to Article 103 of Royal Legislative Decree 1/2007, of November 16, the right of withdrawal is not applicable to service provisions once they have been completely executed. The right of withdrawal is also not applicable to service provisions once their execution has commenced.

In the event that the user exercises the right of withdrawal in a situation where it is not applicable, in accordance with what is established in this clause, GRUP CARLES GESTIÓ I PROJECTES, SL will not refund the amount paid.

In case a refund is necessary, the holder will refund the amount paid in the same manner in which the payment was made.

The client agrees to make lawful use of the payment process, without violating current legislation or harming the rights and interests of third parties.

The client guarantees the accuracy and correctness of the data provided when completing the payment forms, avoiding causing any harm to GRUP CARLES GESTIÓ I PROJECTES, SL due to their inaccuracy.

Personal data

Jurisdiction and Applicable Law

In case of disputes regarding the interpretation or application of these contractual conditions, when dealing with consumers, the competent courts will be those of the place of fulfillment of the obligation or those of the buyer's domicile, in accordance with applicable law.

In the case of a purchase made by a company, both parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of Igualada (Barcelona).
