What is a living will or advance directive?

A living will, also known as an advance directive, is a legal tool that allows individuals to express their preferences regarding medical treatment when they are unable to do so personally, especially in cases of irreversible or terminal illness. Through this document, a representative can be designated to make decisions on behalf of the affected person.

Criteria to consider

In this document, several criteria reflecting the person's personal preferences can be recorded. These may include:

  • The desire not to suffer significant pain, whether physical or psychological.
  • The ability to communicate in any way and maintain relationships with other people.
  • The decision not to prolong life artificially if the essential conditions for a dignified quality of life are not met.
  • The preference to remain in one's usual place of residence during the last days of life and to die there.

How to draw up a living will

A living will can be drawn up before a notary, who will then communicate it to the Generalitat de Catalunya's register of wills and to the Department of Health, so that the professionals treating the person who has drawn it up are aware of its provisions. Alternatively, it can be drawn up before three witnesses who have no family or financial ties to the signatory.
